Terms of Service

Namestorm (the “Service”) is operated by Oaklake Studio (“we”, “us”). These Terms of Service (the “Terms”) govern your access to and use of Namestorm at namestorm.app.

By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

Namestorm lets you check the availability of many domain names at once. You enter a list of name ideas, choose the extensions you care about, and we check each combination and show you which ones look open.

We are not a domain registrar. We do not sell, reserve, or register domains. To register a domain, you go to a registrar such as Namecheap.

Availability is determined automatically: where an extension runs an RDAP service we query it, and otherwise we infer availability from public DNS. Both are estimates. A domain can be registered without resolving in DNS, and records can be stale or momentarily unreachable.

A result of “available” is not a promise that a domain is truly free, and “taken” is not a promise that it is unavailable. Always confirm at a registrar before you rely on a result or make a purchase. We are not responsible for a domain you could not register, or one that turned out differently than a result suggested.

You must be at least 13 years old, and old enough to form a binding agreement where you live, to use the Service. You can run checks without an account. To save shortlists and see your recent searches, you sign in through our authentication provider, Clerk.

You are responsible for keeping your account secure and for activity that happens under it. Provide accurate information, and let us know if you suspect unauthorized use.

Use Namestorm for its intended purpose: researching domain names. You agree not to:

• use the Service to break the law or infringe anyone’s rights;
• probe, scrape, overload, or interfere with the Service or the systems it relies on;
• circumvent rate limits or automate requests in a way that degrades the Service for others;
• resell or repackage the Service or its results as your own product;
• attempt to access data that is not yours.

We may limit, suspend, or end access that we reasonably believe breaks these rules.

The name ideas, extensions, shortlists, and searches you enter are your content, and you keep all rights to them. You grant us a limited license to store and process that content solely to operate and provide the Service to you, for example to run your checks and show your saved shortlist.

You are responsible for the content you enter and for making sure you have the right to use it.

The Service links out to third-party registrars and websites, including Namecheap. Some of these are affiliate links: if you register a domain after following one, we may earn a commission, at no additional cost to you.

This never changes the availability results we show, which are generated independently. We do not control third-party sites and are not responsible for their content, pricing, or practices. Your dealings with a registrar are between you and them, under their own terms.

The Namestorm name, logo, design, and software are owned by Oaklake Studio and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service as offered. You may not copy, modify, or create derivative works of the Service, except as allowed by these Terms or by applicable law.

Namestorm is free, and offered on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. We may add, change, suspend, or discontinue any part of the Service at any time, and we may do so without notice. We do not promise the Service will always be available or error-free.

To the fullest extent permitted by applicable law, Oaklake Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, domains, or opportunities, arising from or related to your use of the Service. To the extent liability cannot be excluded, it is limited to the amount you paid us to use the Service, which for a free service is zero.

You agree to hold Oaklake Studio harmless from claims and costs arising out of your misuse of the Service or your breach of these Terms, to the extent permitted by law. Nothing here limits liability that cannot be limited under applicable law.

You can stop using Namestorm at any time. If you signed in, you can ask us to delete your account and saved data by emailing hi@oaklake.studio. We may suspend or end your access if you breach these Terms or misuse the Service. Sections that by their nature should survive termination, such as intellectual property, disclaimers, and limitation of liability, will continue to apply.

These Terms are governed by the laws of the Federative Republic of Brazil, without regard to conflict-of-law rules. You and Oaklake Studio agree to submit to the courts of the Judicial District of Florianópolis, State of Santa Catarina, Brazil, for any dispute that is not resolved informally, except where applicable law gives you the right to bring a claim elsewhere.

We may update these Terms from time to time. When we do, we will change the “last updated” date at the top of this page, and significant changes may be highlighted in the Service. Your continued use of Namestorm after an update means you accept the revised Terms.
